Privacy Policy

This document explains how NOWY Kolektyw uses your data: what data is collected, to what extent, for what purpose and on what legal basis. It also tells you how your personal data is protected and what your rights are in connection with the processing of your data. 

In this Privacy Policy, we refer to you as a  „User” – the person who uses our website www.nowykolektyw.com (hereinafter: „Website”).

  1. GENERAL TERMS
    1. The Administrator of personal data collected through the Website: www.nowykolektyw.com is Paweł Nowak running a business under the name Nowy Paweł Nowak with its registered office in Gliwice (44-100), Styczyńskiego 20/4 Street VAT EU: PL6312477264 hereinafter referred to as the „Administrator” and who is also the owner of this website.
    2. The Administrator has not appointed a Data Protection Officer.
    3. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (referred to as „RODO”, „ORODO”, „GDPR” or „General Data Protection Regulation”).

  2. LAWFUL AND FAIR PROCESSING OF PERSONAL DATA
    1. The data collected by the Administrator will be:
      1. processed in accordance with the law,
      2. processed for clearly defined purposes and not subject to further processing incompatible with those purposes
      3. accurate and adequate in relation to the purposes for which they are processed
      4. kept for no longer than is necessary to achieve the purposes of the processing.
  3. PURPOSE AND LEGAL BASIS OF THE PROCESSING OF PERSONAL DATA
    1. The Administrator processes the personal data necessary for the provision and development of the services offered through the Website and its individual functionalities.
    2. The processing of personal data will have the following purposes:
      1. communication with the User in order to provide him/her with the necessary information and to establish a positive and reliable relationship with him/her, which constitutes the legitimate interest of the Administrator (Art. 6(1)(f) RODO);
      2. to promote Administrator’s own products and/or services and those of its partners by sending marketing communications by e-mail, provided that the User has consented to receive such communications by e-mail (article 6 (1) (a) RODO);
      3. for analytical and statistical purposes on the basis of the Administrator’s legitimate interest in conducting verification of users’ activities and preferences in order to optimize services and products and applied functionalities of the Service (Article 6(1)(f) RODO);
      4. the possible establishment, investigation or defense of claims based on the Administrator’s legitimate interest in protecting its rights (Article 6(1)(f) RODO).
  4. WHAT TYPE OF PERSONAL DATA IS PROCESSED?
    1. The User may contact NOWY Kolektyw by e-mail. When sending an e-mail, the User provides his personal data to the Administrator, which will be stored.
      1. The data provided will be used only for the purpose of processing the request (including providing answers and possible explanations).
      2. These data will be deleted at the latest when they are no longer necessary to achieve the purpose of the conversation and the subject of the contact is explained.
      3. The User may at any time revoke his or her consent to the processing of personal data. The User may do so by notifying the Administrator of the withdrawal of consent by sending an e-mail to: contact@nowykolektyw.com. In this case, all personal data from the conversation will be deleted and no further conversation will be possible.
    2. When the User uses the Website for informational purposes, Website’s server downloads data transmitted by the User’s web browser and stores some of it in log files, such as
      1. the type of web browser used
      2. the operating system and version
      3. operating system interface
      4. date and time of access to the website
      5. websites visited
      6. access status / http response code
      7. the amount of data transferred
      8. previously visited page.
      This information is not combined or stored with other personal information.
  5. DURATION OF THE PROCESSING OF PERSONAL DATA
    1. The User’s personal data will be processed for the time necessary to fulfill the purposes for which the data are processed:
      1. until the expiry of the limitation period for any claims related to the operation of the Website, including those arising from contracts concluded through it,
      2. until a legitimate objection is raised with regard to data processed for the legitimate interest of the Administrator,
      3. the expiry of the legal obligation to store data, including the obligation to store accounting documents relating to contracts concluded.
  6. INFORMATION ABOUT THE PROCESSING OF PERSONAL DATA
    1. Depending on the purpose of the processing, personal data may be disclosed to
      1. entities affiliated with the Administrator
      2. entities cooperating with the Administrator
      3. subcontractors, in particular companies providing and operating selected IT systems and selected IT systems and solutions
      4. entities processing online payments
      5. entities providing courier and postal services
      6. law firms.
    2. Personal data processed by the Administrator will in some cases be transferred outside the European Economic Area (Google Analytics).
  7. RIGHT HELD BY THOSE AFFECTED (Users)
    1. The User of the Website has the right to:
      1. access to the content of his or her personal data,
      2. request the amendment (correction) of his or her personal data,
      3. deletion of personal data,
      4. limitation of personal data processing,
      5. portability of data,
      6. object to processing carried out on the basis of the controller’s legitimate interest,
      7. withdrawal of consent at any time without affecting the lawfulness of processing carried out on the basis of that consent prior to its withdrawal,
    2. The User has the right to lodge a complaint with the President of the Personal Data Protection Office if he/she considers that the processing violates his/her rights and freedoms.
    3. No automated decision making, including profiling, will be carried out in the data processing.
  8. DATA SECURITY
    1. The Administrator uses appropriate technical security measures to prevent the accidental disclosure of the User’s stored personal data to unauthorized persons or the intentional access to personal data by such persons.
  9. FINAL PROVISIONS
    1. The Administrator reserves the right to make changes to this Privacy Policy at the same time ensuring that the Users’ rights under this document will not be restricted.
    2. The User will be informed of any changes to the Privacy Policy through a message available on the Website.
